Agreement to these terms
These terms are an agreement between you and Rocky Mountain Angling Club, Inc. (“RMAC,” “the Club,” “we,” “us”) covering your use of this website and any purchase you make through our shop. By using the site you accept them. If you do not accept them, please do not use the site.
Our Privacy Policy and our Shipping & Returns policy are part of these terms.
What this site is
This is the Club’s public website. It describes the Club, the water we hold, and how membership works, and it sells official Club gear. It is not where membership itself lives.
Applications, dues, reservations, and the Streamside member community run on AnglerPass, a separate platform with its own terms and privacy policy. When you follow a link from here into AnglerPass, that agreement governs what you do there.
Property descriptions, water conditions, seasons, hatch information, rates, and availability on this site are provided in good faith and can change. Nothing here is an offer of membership or a guarantee of access to any particular water on any particular day.
Membership, reservations, and Club rules
Membership is by application and at the Club’s discretion. Fishing Club water requires current membership, a reservation, and an authorisation number issued by the reservation office — being on Club water without one is trespass.
Members and their guests are bound by the Club’s Rules & Regulations, which govern conduct on the water, reservations, rates, cancellations and refunds of day-rate charges, guests, and termination of membership. Buying from the shop
Club gear is printed to order. Placing an order is an offer to buy; the sale is complete when we accept it and the item goes into production. We may decline or cancel an order — before or after payment — if an item is unavailable, if the price or description was wrong, if we cannot verify the payment or the shipping address, or if we suspect fraud. If we cancel an order you have already paid for, we refund it in full.
Prices are in US dollars and exclude shipping and any tax, which are shown at checkout before you pay. Payment is processed by Stripe under its own terms. What happens after you pay — production time, delivery, damaged or wrong items, cancellations, and refunds — is set out in Shipping & Returns.
Acceptable use
Please do not:
- use the site for anything unlawful, or to harass, defraud, or impersonate anyone;
- scrape, harvest, or systematically copy the site’s content, photography, or property information, or use it to build a competing service;
- attempt to gain access to any part of the site, or any system or account, that is not open to you;
- probe, overload, or interfere with the site’s operation or security, or introduce malicious code; or
- place orders you do not intend to pay for, or use another person’s payment details.
We may suspend or block access to the site for anyone who does these things.
Our content and our marks
Everything on this site — the writing, the photography, the layout, the code, and the Club’s property information — is owned by the Club or used with permission, and is protected by copyright. The Rocky Mountain Angling Club name, the trout emblem, and the Club wordmark are our trademarks.
You may read, print, and share pages for your own non-commercial use. Anything else — republishing, reselling, altering, or using our photography or marks in your own materials — needs our written permission first.
Photographs you send us
Members send us catch photographs for the Bragging Board. If you send us a photograph, you confirm that it is yours to share, that anyone identifiable in it agrees to it appearing, and that the fish was caught and released in line with Club rules. You keep ownership of your photograph.
By sending it, you give the Club a non-exclusive, royalty-free licence to publish it on this site and in Club materials, with credit where you have asked for it. We are not obliged to publish anything, and we may take a photograph down at any time. If you want yours removed, write to us and we will do it.
Other sites and listings
Our Resources page lists independent fly shops, guides, outfitters, and lodging near Club water because members ask us who we trust. They are not our agents or partners, we do not control what they do, and a listing is not a warranty of their services. Any dealing you have with them is between you and them.
Fishing carries risk
Fishing Club water means moving water, uneven ground, weather that turns, wildlife, and remote country where help is not close. Those risks are real and they are yours to weigh. Nothing on this site is a representation that any property is safe, that conditions will be fishable, or that a road will be passable. Members and guests are responsible for their own safety, their own equipment, and their own judgement on the water, and for complying with all state fishing regulations and licence requirements.
Disclaimers
The site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that the information on it is complete, current, or accurate at every moment.
Limitation of liability
To the fullest extent the law allows, neither the Club nor its officers, directors, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of this site — whether the claim is brought in contract, tort, or otherwise, and even if we were told such damages were possible.
Our total liability for any claim relating to this site or a shop order is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars. Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
Indemnification
You agree to indemnify and hold the Club harmless from claims, losses, liabilities, and reasonable legal costs arising out of your misuse of the site, your breach of these terms, your infringement of anyone’s rights, or content you send us.
Governing law and where disputes are heard
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of the site will be brought exclusively in the state or federal courts located in Larimer County, Colorado, and you consent to their jurisdiction.
Any claim relating to this site or a shop order must be brought within one year after it arises, or it is permanently barred, except where the law does not permit such a limit.
General
If any part of these terms is found unenforceable, the rest stays in force. If we do not enforce a provision, that is not a waiver of it. You may not assign these terms; we may assign them in connection with a sale or reorganisation of the Club. Together with the Privacy Policy and the Shipping & Returns policy, these terms are the entire agreement between us about the site.
Changes to these terms
We may update these terms. The revised version takes effect when we post it, with a new date at the top, and applies to your use of the site from that point. Orders are governed by the terms in force when you placed them. If you keep using the site after a change, you accept the revised terms.
