The undersigned hereby applies for membership in Rocky Mountain Angling Club, Inc. (“RMAC”), both individually and on behalf of his or her minor children, as listed below. The undersigned agrees to pay all fees charged by RMAC from time to time and to comply with all rules, regulations and policies of RMAC as in effect from time to time and to assure that all such children and all guests of the undersigned do the same. The undersigned understands that failure to abide by such rules, regulations and policies may result in revocation of the membership.

If the undersigned brings guests to the RMAC properties, the undersigned shall obtain the signature of each such guest on the Guest Agreement form included with the RMAC property book and deliver the signed Guest Agreement to RMAC prior to such guest’s entry on the RMAC properties.

The undersigned, both individually, on behalf of the heirs, executors, administrators, and legal representatives of the undersigned, and on behalf of his or her minor children and their heirs, executors, administrators and legal representatives, is aware of and accepts the potential hazards thatare associated with stream, river and lake fishing, including without limitation the risk of death or injury attributable to swift currents, deep water and unstable footing, and releases the owners of the RMAC properties, RMAC and each of their agents and employees (the “Released Parties”) from any damage to person or property that the undersigned or such minor children might suffer as the result of their entry on the RMAC properties, except for damages caused by the gross negligence or intentional misconduct of the Released Parties.

The undersigned shall indemnify and save harmless the Released Parties from 1) any costs, expenses, losses or dam- ages (including attorneys’ fees and expenses, court costs, judgments and amounts paid in settlement) incurred in connection with or as a result of the undersigned’s or his or her children’s or any such guest’s entry on the RMAC properties; or 2) for any such guest’s failure to sign a form of Guest Membership Application or any violation of any applicable statute, ordinance, regulation, policy or rule; provided, however, that the Released Parties were not guilty of contributing gross negligence or willful misconduct.
